Please read these Terms of Service ("Terms") carefully before using the MindFood mobile application (the "App") operated by Apparent Group Limited ("Company", "we", "us", or "our").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

1. Description of Service

MindFood is a microlearning and book summary application that provides users with access to condensed insights, mini-courses, quizzes, and challenges through text and audio formats. The content within the App, including summaries and learning materials, is generated using Artificial Intelligence (AI) technologies.

2. Accounts and Registration

To access certain features of the App, you may be required to register an account.

  • Accuracy: You agree to provide accurate, current, and complete information during the registration process.
  • Security: You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password.
  • Sharing: You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • Eligibility: You must be at least 16 years old (or the minimum age of digital consent in your country) to use the App.

3. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)").

  • Billing: Subscriptions are managed and billed by the applicable app store (Apple App Store or Google Play Store). You will be charged through your app store account.
  • Renewal: Your Subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours before the expiry of the current period.
  • Cancellation: You can manage or cancel your Subscription at any time through your account settings on the Apple App Store or Google Play Store. We cannot cancel subscriptions on your behalf.
  • Refunds: Refund requests are handled by the respective app store in accordance with their refund policies.

4. Intellectual Property

The App and its original content (excluding content owned by third parties), features, and functionality are and will remain the exclusive property of Apparent Group Limited and its licensors.

  • App Content: The AI-generated summaries, quizzes, and course structures provided in the App are owned by us.
  • Restrictions: You may not copy, modify, distribute, sell, or lease any part of our App or included content, nor may you reverse engineer or attempt to extract the source code of that software.

5. User Conduct

You agree not to use the App:

  • In any way that violates any applicable national or international law or regulation.
  • To engage in any activity that interferes with or disrupts the App or the servers and networks connected to the App.
  • To attempt to access any service or area of the App that you are not authorized to access.
  • To scrape, collect, or harvest data or content from the App using automated means.

6. AI Content Disclaimer

The educational content and book summaries within MindFood are generated with the assistance of Artificial Intelligence. While we strive for accuracy and quality:

  • Accuracy: We do not guarantee the absolute accuracy, completeness, or timeliness of the information provided. The summaries are interpretations and may not capture every nuance of the original works.
  • Not Professional Advice: The content is for educational and informational purposes only and should not be considered as professional advice (e.g., financial, medical, or legal advice). You should consult with a qualified professional before making decisions based on the content.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Apparent Group Limited, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the App;
  • Any conduct or content of any third party on the App;
  • Any content obtained from the App; and
  • Unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by updating the "Last Updated" date at the top of this document. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
